Please read these Terms of Service ("Terms") carefully before using Boonwerks's products and services. By creating an account or accessing any part of the platform, you agree to be bound by these Terms.

1. Our Services

Boonwerks provides a cloud-based platform that helps teams launch, manage, and scale digital experiences. Features may include hosted websites, portals, APIs, workflow automation, analytics, and related professional services. We may update or modify features from time to time to improve the platform.

2. Eligibility and Accounts

You must be at least 18 years of age (or the age of majority in your jurisdiction) to create an account. You agree to provide accurate, complete registration information and to keep that information current. You are responsible for all activity that occurs under your account, including maintaining the confidentiality of your credentials.

3. Fees and Payment

Boonwerks offers subscription plans and usage-based services. Pricing, billing cycles, and included features are described in the applicable order form, plan selection, or invoice. By selecting a paid plan, you authorize us to charge the applicable fees using your chosen payment method. Fees are non-refundable except where required by law or explicitly stated in an order form.

4. Acceptable Use

You agree not to misuse the platform. Prohibited activities include (a) violating any law or regulation; (b) infringing the intellectual property or privacy rights of others; (c) uploading malicious code, spam, or abusive content; (d) attempting to gain unauthorized access to the platform or related systems; or (e) reselling or white-labeling the services without written permission.

5. Intellectual Property

Boonwerks retains all right, title, and interest in and to the platform, including all related intellectual property. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the services for your internal business purposes. You retain ownership of content you upload, provided you grant Boonwerks the rights necessary to operate and improve the services.

6. Privacy

Our collection and use of personal information is described in the Boonwerks Privacy Policy. By using the services, you consent to the processing of your information in accordance with that policy.

7. Confidentiality

Each party may receive non-public information from the other. Both parties agree to protect confidential information using reasonable safeguards and to use it only for the purpose of delivering or receiving the services.

8. Warranty Disclaimer

The services are provided on an "as-is" and "as-available" basis. Boonwerks disclaims all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by law, Boonwerks shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising from or relating to the services. Our aggregate liability for direct damages shall not exceed the fees you paid to Boonwerks in the twelve (12) months preceding the event giving rise to the claim.

10. Termination

Either party may terminate an account at any time. We may suspend or terminate access to the services if you violate these Terms or if required for legal or security reasons. Upon termination, your right to access the services will cease, but Sections 4–11 of these Terms will survive.

11. Governing Law

These Terms are governed by the laws of the State of [STATE], without regard to conflict of law principles. Any dispute will be resolved exclusively in the state or federal courts located in [COUNTY], [STATE], and you consent to their jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new effective date. Your continued use of the services after changes become effective constitutes acceptance of the revised Terms.
